Furkan Lüleci (operating as Magic Kids AI) ("Company," "we," "us," or "our") places great importance on the privacy of its users, especially children. This Privacy Policy explains what personal information we collect through our website, applications, and related services (collectively, the "Service"), how we use this information, with whom we share it, and how we protect your data.

By accessing or using our Service, you consent to the data collection, use, and sharing practices described in this Privacy Policy. As a parent or legal guardian ("Parent") permitting your child to use the Service, you agree to this Privacy Policy on behalf of both yourself and your child.

1. Our Commitment to Children's Privacy

Our Service is primarily designed for use by children aged 6-12 under the supervision and with the consent of their Parents. We aim to comply with applicable child privacy laws and regulations, including the Children's Online Privacy Protection Act (COPPA) in the USA, the General Data Protection Regulation-Kids (GDPR-K) in the European Union, and UK-GDPR in the United Kingdom.

2. Information We Collect

2.1. Information We Collect from Parents:

  • Account Information: When a Parent creates an account, we collect information such as your name (optional) and email address.
  • Payment Information: Subscription payments are processed by our third-party payment processor, Paddle Inc. ("Paddle"). You provide your payment information (e.g., credit card number) directly to Paddle. We do not store this financial information, but we may receive transaction-related information from Paddle, such as your subscription type, transaction date, and payment status.
  • Communication Information: When you contact us (e.g., for support requests or feedback), we collect your email address and any other information you provide.
  • Usage Information: We may collect information about how you use the Service (e.g., types of content generated – general metadata not containing personal data, feature usage, session durations). This information is generally kept anonymous or aggregated.

2.2. Information We Collect (or Do Not Collect) from Children:

  • Principle of Not Entering Child's Personally Identifiable Information (Child PII): As clearly stated in Article 5.1 of our Terms of Service, our Service is not designed for the collection, storage, or specific processing of Child PII such as the child's full name, photograph, home address, phone number, school name, ID number, or biometric data. The Service does not technically require or encourage the entry of such information.
  • Parental Obligation: The Parent undertakes, as per Articles 4.4 and 5.1 of the Terms of Service, not to enter, upload, or transmit any text, image, audio, or file containing Child PII to the Service.
  • AI Inputs (Prompts): Prompts given by the user to the AI are processed in temporary memory areas solely to generate the requested output (e.g., story, image). It is the Parent's responsibility to ensure these prompts do not contain Child PII. The Company does not actively scan or filter these inputs for Child PII. These inputs may be analyzed in an anonymized and aggregated form for Service improvement.

2.3. Automatically Collected Information (Technical Data):

  • Device Information: We may collect technical information such as IP address, device type, operating system, browser type, and language preferences.
  • Cookies and Similar Technologies: We may use cookies and similar tracking technologies to enable the functionality of our Service, improve user experience, and conduct usage analytics. You can manage your cookie preferences through your browser settings.

3. How We Use Information

We use the information we collect for the following purposes:

  • To provide, maintain, and improve the Service.
  • To manage Parent accounts and provide support.
  • To process subscriptions and payments (via Paddle).
  • To send Service updates, security alerts, and administrative messages.
  • To enforce our Terms of Service and prevent illegal activities.
  • To conduct anonymous or aggregated statistical analysis about the use of our Service.
  • To comply with legal obligations.

4. How We Share Information

We do not share your personal information with third parties except in the following circumstances:

  • Service Providers: We may share information with third-party service providers who perform services on our behalf, such as payment processing (Paddle Inc.), data storage, customer support, and analytics. These providers are obligated to use your information only to perform services on our behalf and to protect its confidentiality.
  • Legal Obligations and Protection of Rights: We may disclose your information if required by law, in response to a subpoena or similar legal process, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of the Company, our users, or the public.
  • Business Transfers: In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be part of the transferred assets. We will notify you via email and/or a prominent notice on our website in such an event.
  • With Parent's Explicit Consent: We may share information with explicit consent from the Parent for specific purposes.

We will NEVER share Child PII (even if inadvertently entered) with third parties for marketing or advertising purposes.

5. Data Security

We take reasonable administrative, technical, and physical measures to protect the security of your personal information. However, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee its absolute security. The Parent is responsible for maintaining the confidentiality of their account password and for all activities related to their account.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required to comply with our legal obligations (e.g., financial records), resolve disputes, and enforce our agreements. Upon request for deletion of a Parent account, the Parent's personal data will be deleted or anonymized within a reasonable time, subject to legal retention obligations. Since Child PII is not intentionally collected or stored, such data is not expected to be subject to routine deletion; however, Parents may request the deletion of any Child PII inadvertently entered and identified.

7. International Data Transfers

As our Service is offered globally, your information may be processed and stored on servers located outside your country of residence (including Turkey). We will take necessary steps to ensure that your data is treated securely and in accordance with this Privacy Policy.

8. Parental Rights and Choices (Under COPPA & GDPR-K)

As a Parent, you have the following rights:

  • To Review the Information We Have Collected (or Not Collected) from Your Child: As our Service is not designed to collect Child PII, there is no intentionally collected PII profile for your child. However, you can inquire about any data that might have been inadvertently entered in association with your account.
  • To Request Deletion of Your Child's Information: You can request the deletion of any Child PII that may have been inadvertently entered through your account. You can also request the deletion of your Parent account and associated personal data (Terms of Service Article 5.5).
  • To Refuse Further Collection or Use of Your Child's Information: You can do this by ceasing your child's use of the Service and/or deleting your account.
  • Access, Rectification, Portability (for Parent Data): You can exercise your rights under GDPR and other applicable data protection laws regarding your own Parent account information, such as access, rectification, erasure (right to be forgotten), restriction of processing, and data portability.

9. Third-Party Links and Services

We will notify you of significant changes via your registered email address and/or by posting a prominent notice within the Service before they take effect.
